Welcome to Impact Housing. These Terms of Use ("Terms") govern your use of impacthousing.homes, the Impact Housing resident and provider portals, and related online services (together, the "Services"), operated by Impact Housing LLC, doing business as Impact Housing ("Impact," "we," "us"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services. You must be at least 18 years old to use the Services.
1. What we do — and what we don't.
Impact and its affiliated property owners operate shared, sober, independent-living homes in Georgia and provide housing only. The Services let you learn about our homes, apply for housing, sign documents, view balances and records, request maintenance, and communicate with us. We do not provide medical, nursing, personal-care, treatment, counseling, case-management, or emergency services through the Services or otherwise. If you are experiencing an emergency, call 911.
2. Accounts and sign-in.
You sign in with your email address and a password. You are responsible for keeping your password and email account secure, for not sharing your login credentials, and for activity that occurs through your access. We use email only to confirm your address and to reset your password. Tell us right away at info@impacthousing.homes if you believe your account has been accessed without permission. You agree to provide accurate, current information and to keep it updated.
3. Applications and housing decisions.
Submitting an application is not an offer of housing and does not guarantee placement. Housing is provided only under a signed Occupancy License Agreement and related documents. We evaluate applications consistent with our written criteria and the federal Fair Housing Act and applicable Georgia law. Information you submit must be truthful; false or misleading information may result in denial or termination under your housing documents.
4. Your housing documents control.
These Terms govern your use of the website and portals. Your occupancy and housing relationship are governed by your signed Occupancy License Agreement, House Rules, and related documents; if these Terms conflict with those documents on any housing matter, those documents control.
5. Payments.
The portal may display balances, payment records, and receipts. Where online payments are offered, they are processed by third-party payment processors under their own terms, and you authorize the payments you initiate. If you believe a charge or record is in error, contact us promptly at info@impacthousing.homes and we will review it.
6. Acceptable use.
You agree not to: use the Services for any unlawful purpose; access or attempt to access another person's account or information; probe, scan, disrupt, overload, or interfere with the Services or their security; scrape, harvest, or copy data at scale; introduce malware or harmful code; misrepresent your identity or affiliation; or use the Services to harass, threaten, or harm anyone. We may suspend or terminate access for violations.
7. Our content.
The Services and their content — text, graphics, logos, photos, and software — belong to Impact or its licensors and are protected by law. We grant you a limited, revocable, non-transferable license to use the Services for their intended personal purposes. You may not reuse our content publicly without our written permission. If you send us feedback or suggestions, we may use them without restriction or obligation.
8. Your submissions.
You keep ownership of the information and materials you submit. You grant Impact a license to use them as needed to operate the Services and administer your housing, consistent with our Privacy Policy and any consent forms you sign.
9. Communications.
By providing your email and phone number you agree to receive service communications about your account, applications, documents, and housing. Text-message terms (including STOP/HELP) are described in our Consent to Electronic Records, Signatures & Communications and apply to all texts we send. We do not send marketing texts without a separate opt-in.
10. Third-party services.
The Services may link to or rely on third-party sites and services (for example, e-signature, mapping, video hosting, or payment processing). Those are governed by their own terms and privacy policies, and we are not responsible for them.
11. Privacy.
Our Privacy Policy explains what information we collect and how we use, share, and protect it. It is part of these Terms.
12. Disclaimers.
The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-interruption. Home availability, pricing, photos, and descriptions shown on the Services are informational, may change, and are not binding offers.
13. Limitation of liability.
To the fullest extent permitted by law, Impact and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of the use of the Services, and our total liability for claims relating to the Services will not exceed the greater of one hundred dollars ($100) or the amounts you paid us for the Services in the twelve (12) months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law, or limits your rights under your signed housing documents or under Georgia landlord-tenant statutes.
14. Indemnification.
You agree to indemnify and hold Impact harmless from claims arising out of your violation of these Terms or your misuse of the Services, to the extent permitted by law.
15. Suspension and termination.
We may suspend or end your access to the Services at any time for violation of these Terms or to protect the Services or other users. Ending portal access does not, by itself, change any rights or duties under your signed housing documents.
16. Dispute resolution; governing law.
Before filing any claim about the Services, you agree to first contact us at info@impacthousing.homes and give us thirty (30) days to try to resolve it informally. Georgia law governs these Terms, and any dispute about the Services will be brought in the state or magistrate courts of Bibb County, Georgia. Either party may bring qualifying claims in small-claims (magistrate) court.
17. Changes to these Terms.
We may update these Terms from time to time. We will post the updated version with a new effective date and, for material changes, notify account holders through the portal or by email. Continued use after changes take effect means you accept them.
18. Fair housing.
Impact does not discriminate on the basis of race, color, religion, sex, national origin, familial status, disability, or any other status protected by federal or Georgia law.
